Privacy Policy
This policy explains what personal data is processed when you play Dead Air: Breakwater (the "Game"), including its playtest builds, and when you visit this website. It also explains your rights and how to have your data deleted. The Game is developed by Nightmare Tech ("we", "us").
The short version
- We do not run accounts, analytics, advertising or tracking. We never sell or rent your data.
- Your saves, settings and logs stay on your own computer. The Game does not send them to us.
- Co-op connects players' computers directly, so players in the same session see each other's IP address and player name.
- If you sign in with your Epic account, the Game receives only your Epic Account ID and display name.
- You can ask us to see or delete anything we hold about you by emailing contact@nightmare-tech.com.
1. Who we are
The controller responsible for personal data processed by the Game and this website is Nightmare Tech, the Netherlands. Contact: contact@nightmare-tech.com.
We are an independent developer. We have not appointed a data protection officer because the law does not require one for processing of this scale. Send any privacy question to the address above.
2. What we process and why
| Data | Source | Purpose | Where it goes |
|---|---|---|---|
| Epic Account ID and display name | Epic, only after you sign in and agree | Identify you in the Game and to other players in co-op | The Game on your computer, other players in your session |
| IP address and player name during co-op | Your computer, when you host or join | Connect players to each other and keep the session running | The other players in the session only |
| Saves, settings and log files | Created by the Game | Keep your progress and settings, help diagnose problems | Your computer only |
| Epic Account ID and display name of invited testers | You, when you ask to join a playtest | Give you access to the playtest build | Us and Epic (Developer Portal) |
| Email address, messages, and any logs or screenshots you choose to send | You | Answer you, fix bugs, improve the Game | Us |
| IP address, browser type and requested page | Your browser, when visiting this site | Deliver the website and protect it from abuse | Our hosting provider |
We do not ask for, and the Game does not collect, your real name, postal address, phone number, payment details, contacts, precise location, microphone or camera input, or any special category of data.
3. Epic Games and Epic Account Services
Epic Games Store and Launcher
The Game, including its playtest, is distributed through the Epic Games Store. Your Epic account, purchases, key redemption, downloads and launcher activity are handled by Epic Games, Inc. as an independent controller under its own privacy policy. We do not see your Epic password, email address or payment information.
Epic Account Services (sign-in)
The Game uses Epic Account Services so that it can recognise you when you start it from the Epic Games Launcher. The first time a build uses this, Epic shows you a consent screen listing exactly what the Game is asking for. If you agree, the Game receives:
- Epic Account ID: a random identifier for your account.
- Display name: the public name on your Epic account.
We use these only to identify you in the Game and, in co-op, to show your name to the other players in your session. We do not request your email address, friends list or online presence. If a later version needs more, we will update this policy first, and Epic will ask for your consent again.
You can withdraw this permission at any time in your Epic account under Account › Apps and Accounts. After that, the Game can no longer receive your account details.
4. Co-op multiplayer
Co-op works peer-to-peer. One player's computer hosts the session and up to three others connect to it directly, using the host's IP address or the local network. We do not operate game servers, so co-op traffic does not pass through us.
- The host's computer receives the IP address of each player who joins, and each player who joins learns the host's IP address.
- Every player in a session can see the other players' names. If you are not signed in with Epic, the name in current playtest builds may be generated from your computer's network name.
- The Game has no text or voice chat.
Only play co-op with people you trust with your IP address. Your internet provider can tell you more about what an IP address reveals.
5. Data stored on your computer
The Game stores these files locally on Windows, under %LOCALAPPDATA%\DeadAir\Saved\:
- Save file: progress, unlocked items, discovered lore, lifetime statistics (such as runs, kills and best wave) and your game options.
- Settings: graphics, audio and input preferences.
- Log and crash files: technical information used to diagnose problems. Logs can include your hardware and driver details and the IP addresses of co-op sessions you hosted or joined.
These files never leave your computer unless you choose to send them to us. We cannot see or access them.
6. Playtests and feedback
Playtest access is by invitation. To give you access, we add your Epic Account ID to a private tester group in the Epic Developer Portal and send you a key. To do that we need your Epic Account ID, your display name and a way to reach you, usually your email address.
If you report a bug or send feedback, we receive whatever you choose to include, such as your message, log files or screenshots. We use it only to answer you and to fix and improve the Game. Look at log files before you send them and remove anything you would rather not share.
Playtest participation is voluntary. You can leave at any time by emailing us. We will then remove you from the tester group and delete your playtest contact details.
7. This website
This website sets no cookies, uses no analytics or tracking, and loads no third-party fonts, scripts or embeds. It is hosted by Vercel Inc. Like any web server, the host processes your IP address, browser type and the pages you request in order to deliver the site and protect it from abuse. It may keep these server logs for a short time under its own privacy policy. We do not use them to identify visitors.
8. What we do not do
- No selling, renting or trading of personal data, and no "sharing" for cross-context behavioural advertising.
- No advertising, ad networks or ad identifiers.
- No analytics, telemetry or tracking SDKs in the Game or on this website.
- No automated decisions or profiling that have legal or similarly significant effects on you.
- No in-game purchases processed by us.
9. Legal bases
Where the EU or UK General Data Protection Regulation (GDPR) applies, we rely on these legal bases:
- Performance of a contract (Art. 6(1)(b)): providing the Game, co-op sessions and playtest access you asked for.
- Consent (Art. 6(1)(a)): receiving your Epic account details through Epic Account Services. You can withdraw consent at any time, which does not affect processing that took place before.
- Legitimate interests (Art. 6(1)(f)): answering messages, fixing bugs reported to us, and keeping this website secure. We only rely on these where they are not overridden by your interests and rights.
- Legal obligation (Art. 6(1)(c)): where the law requires us to keep or disclose information.
10. Who receives data
- Epic Games, Inc., which runs the store, launcher, sign-in and the tester group (see section 3).
- Other players in your co-op session, who see your player name and exchange IP addresses with you (see section 4).
- Our hosting provider for this website (Vercel Inc.) and our email provider, acting on our behalf.
- Authorities, only where the law requires it or to protect the rights and safety of people.
- A successor, if the Game is transferred to another developer or publisher. This policy, or one at least as protective, would continue to apply, and we would tell you in advance.
11. International transfers
Epic Games, Inc. and some service providers are based outside your country, including in the United States. Where personal data from the European Economic Area, the UK or Switzerland is transferred to a country without an adequacy decision, the transfer relies on appropriate safeguards, such as the European Commission's Standard Contractual Clauses or the recipient's certification under the EU-U.S. Data Privacy Framework. You can ask us for details of these safeguards.
12. How long we keep data
| Data | Kept for |
|---|---|
| Epic Account ID and display name in the Game | Only on your computer, for as long as you use the Game. Never stored by us. |
| Co-op IP addresses and names | Only for the duration of the session, plus any local log files on the players' own computers. |
| Saves, settings and logs | On your computer until you delete them or uninstall the Game. |
| Playtest tester details | Until the playtest ends, then deleted within 90 days. Earlier if you leave or ask. |
| Emails, feedback and files you send | Up to 24 months after the matter is closed, unless you ask us to delete them sooner. |
| Website server logs | The hosting provider's standard period, normally a few days to a few weeks. |
13. Your rights
Depending on where you live, you have the right to:
- access the personal data we hold about you and get a copy;
- correct inaccurate data;
- delete your data ("right to be forgotten");
- restrict or object to processing, including processing based on legitimate interests;
- data portability, receiving your data in a common machine-readable format;
- withdraw consent at any time, where processing is based on consent;
- complain to a data protection supervisory authority, in particular in the country where you live or work or where an alleged infringement took place. In the Netherlands, where we are based, this is the Autoriteit Persoonsgegevens.
California and other U.S. state residents also have the right to know, delete and correct personal information, and not to be discriminated against for using these rights. We do not sell or share personal information and do not use sensitive personal information, so there is nothing to opt out of.
To use any right, email contact@nightmare-tech.com. We will answer within one month (this can be extended by two more months for complex requests, and we will tell you if so). We may ask for information to confirm the request comes from you, such as your Epic display name. Exercising your rights is free.
14. How to delete your data
- Data on your computer: uninstall the Game in the Epic Games Launcher, then delete the folder
%LOCALAPPDATA%\DeadAir. - Epic sign-in permission: remove Dead Air: Breakwater under Apps and Accounts in your Epic account.
- Data we hold (playtest details, emails and feedback): email contact@nightmare-tech.com with the subject "Delete my data". We will delete it within 30 days and confirm.
- Your Epic account itself: this is managed by Epic. See Epic's privacy policy and account settings.
15. Children
Dead Air: Breakwater is a horror game with violence and is intended for adults and older teenagers. It is not directed at children under 13, or under 16 where local law sets a higher age for consent to data processing. We do not knowingly collect personal data from children. If you believe a child has sent us personal data, contact us and we will delete it. Epic applies its own age and parental-consent rules to Epic accounts.
16. Security
We keep the personal data we hold to a minimum, store it in password-protected accounts with two-factor authentication where available, and limit access to the people who need it. This website is served only over HTTPS. No method of storage or transmission is completely secure. If a breach affects your data, we will notify you and the relevant authorities as the law requires.
17. Changes to this policy
We will update this policy when the Game or our practices change, for example before a new build uses new Epic Account Services permissions. The date at the top shows the latest version. For significant changes, we will also give notice in the Game or on this website before they take effect.
